of Inkango.com, and/or its various subsidiaries or affiliates, and is protected
under the copyright laws of Canada and other countries. None of the content
found on Inkango.com may be reproduced, republished, distributed, displayed,
sold, transferred, or modified without the express written permission of
Inkango.com.
The Inkango.com logo and Inkango.com-related trademarks appearing on this
website are registered and owned by Inkango.com. Other products and company
names and logos appearing this website may be registered or unregistered
trade-names, trademarks and service-marks of their respective owners. Any
use of the trade-names, trademarks, service-marks and logos (collectively
"Marks") displayed on this website, except as expressly provided
in this Agreement, is strictly prohibited. Nothing appearing on this website
or elsewhere shall be construed as granting, by implication, or otherwise,
any license or right to use any Marks displayed on this website.
USE OF SITE
The Inkango.com website may not, in whole or in part, be copied, reproduced,
republished, uploaded, posted, transmitted or distributed without the written
permission of Inkango.com, except that you may download, display and print
the materials presented on Inkango.com for your personal, non-commercial
use only. Unauthorized use of Inkango.com and/or the materials contained
on Inkango.com may violate applicable copyright, trademark or other intellectual
property laws or other laws.
Inkango.com reserves the right to limit quantities, refuse orders, terminate
accounts, and/or cancel orders in its discretion, including, without limitation,
if Inkango.com believes that customer conduct violates applicable law or
is harmful to the interests of Inkango.com or any third parties.
You may not post, upload or transmit any content that is unlawful, harmful,
threatening, abusive, harassing, defamatory, libelous, vulgar, obscene,
or tortuous, or that infringes or violates any third party's copyright,
trademark, trade secrets, privacy or other proprietary or property rights
or that could constitute a criminal offence, give rise to civil liability
or otherwise violate any applicable law.

The inkango.com Photo Club may be used only for personal, non-commercial
purposes and must not be used in connection with any commercial activities.
Inkango.com is not obliged to monitor, screen, police or edit the use of
the online photo-club, including postings of materials to our website, although
we reserve the right to do so in our sole discretion. We will respond as
we consider appropriate, in our sole discretion, if we become aware of any
inappropriate uses of the online photo-club.
SECURITY POLICY
In order to reduce fraud on our website, we validate every order placed
on Inkango.com for security purposes. For increased online security and
protection, all credit card information is transmitted using Secure Socket
Layer (SSL) via a secure server. We only accept credit cards issued from
Canadian or American financial institutions. When using a credit card that
is issued in the United States, all transactions will be settled in Canadian
dollars at an exchange rate determined by the issuing institution at the
time of payment settlement.
It is necessary for you to correctly enter your credit card number and address
that appears on your credit card statement. If you are shipping to an address
other than your credit card billing address we strongly suggest that you
contact your card issuing bank (the number is located on the back of your
card) to add an alternate shipping address to your file. This will assist
our credit card department in validating your order and will prevent any
additional delays in processing your order.
In most cases the information you have provide will allow for timely processing
of your order. However, you may be required to send us additional information
or documentation to complete your transaction. If so, we will contact you
either by phone, or by email, outlining what needs to be sent. This can
be sent to us either by fax at (450)629-8622, or by replying to that email,
with either .jpeg, .pdf or .gif attachments. For example, we might need
one of the following from you:

These measures are intended for our customer’s protection to protect
against fraudulent transactions. We are sorry about the inconvenience this
may cause you, and we reserve the right not to process any order at our
own discretion.
PRICING POLICY
While we strive for pricing accuracy, market conditions and competitive
pressures may cause prices and availability to change without further notice.
We reserve the right to correct, at any time, any pricing errors and to
refuse to complete a sale that is a subject of a pricing error.
All prices quoted are payable in Canadian Dollars and, unless otherwise
stated, do not include shipping charges, GST, PST, QST or HST.
SHIPPING POLICY
Any products purchased from Inkango.com are delivered to you by a third
party shipping company, pursuant to a shipping contract. The delivery policy
outlined on this website applies to addresses located in Canada only. The
risks of loss for such products pass to the purchaser at the time of delivery
by Inkango.com to the third party shipper.
RETURNS AND EXCHANGES
When you receive your package, we ask that you examine it closely prior
to opening the factory sealed product packaging. If you are not satisfied
with your order or if you receive a defective product, you may exchange
or return your product. We would be pleased to exchange or give you a refund
on most items you buy online, up to 10 days after your receive your order.
Please follow these steps to ensure your product is returned in its original
condition along with all accessories and instructions.
Before returning any item(s) to Inkango.com, please ensure you:

authorization' number issued by Inkango.com, please use our special
on-line returns system to obtain your RMA returns number. |

All products (both defective and non-defective) must be returned in their
original purchase condition, with the original packing material, blank warranty
cards, manuals and any other item or accessory provided by the manufacturer.
In the event that a returned order has items missing, the order may be refused,
or the value of the missing materials may be deducted from the total credit
amount. Please note that shipping and handling charges are non-refundable;
however, we will gladly refund your original shipping cost if you are returning
an item because of an error on our part, or we have determined that the
product is defective.
All returns are subject to inspection and we reserve the right to refuse
any merchandise. If you require more information or require assistance with

PRODUCT WARRANTIES
All products are covered by the manufacturers’ warranty, unless otherwise
stated, from the date of delivery.
All warranties exclude faults caused by neglect, misuse or accidental damage.
LIABILITY DISCLAIMER
Except as explicitly provided in the foregoing paragraphs, Inkango.com makes
no representations or warranties of any kind, express or implied, regarding
the website and/or any materials provided on the website, all of which are
provided on an "as is" and "as available" basis. Inkango.com
does not warrant the accuracy, completeness, currency, reliability or suitability
of the operation of the website, or any of the content or data found on
the website, and expressly disclaim all warranties and conditions, including
implied warranties and conditions of merchantability, fitness for a particular
purpose, title and non-infringement, and those arising by statute or otherwise
in law or from a course of dealing or usage of trade.
Inkango.com and Third parties are not responsible for late, lost, incomplete,
illegible, misdirected or stolen messages or mail, unavailable network connections,
failed, incomplete, garbled or delayed computer transmissions, on-line failures,
hardware, software or other technical malfunctions or disturbances or any
other communications failures or circumstances affecting, disrupting or
corrupting communications.
Inkango.com assumes no responsibility, and shall not be liable for any damages
to, or viruses that may infect your computer equipment or other property
on account of your access to, use of, or browsing on Inkango.com or the
downloading of any materials, data, text, images, video or audio from the
website. In no event shall Inkango.com be liable for any injury, loss, claim,
damage, or any special, exemplary, punitive, direct, indirect, incidental
or consequential damages of any kind (including, but not limited to lost
profits or lost savings), whether based in contract, tort, strict liability,
or otherwise, which arises out of or is in any way connected with any use
of the website or content found herein, any failure or delay (including,
but not limited to the use of or inability to use any component of the website
for purchases), of the performance or non performance by Inkango.com.
MAXIMUM LIABILITY
If, notwithstanding the foregoing, Inkango.com or any of the Third Parties
should be found liable for any loss or damage which arise out of or is in
any way connected with any of the functions or uses of inkango.com or its
content, the liability of inkango.com and the Third Parties shall in no
event exceed in the aggregate $250 CAD.
INDEMNIFICATION
You shall indemnify and save harmless Inkango.com and its officers, directors,
employees, consultants, representatives and agents from and against any
claim, cause of action or demand, including without limitation reasonable
legal, accounting and other professional fees, brought as a result of your
use of the website.
PRIVACY POLICY AND MODIFICATION
Inkango.com collects, uses, and discloses your personal information in accordance
with the Privacy
Policy. Inkango.com may change the Privacy Policy from time
to time in its sole discretion. By accepting this Agreement, and each time
you use this website, you consent to our collection, use and disclosure
of your personal information in accordance with the Privacy Policy as it
then exists without any further notice or any liability to you or any other
person.
Inkango.com reserves the right to, without notice, make changes to the site,
including the online Photo Club and Privacy Policy, and may at any time
modify the Terms and Conditions of use of Inkango.com. Your continued use
of Inkango.com will be conditioned upon your acceptance of the Terms and
Conditions in force at the time of your use.
ACCESS AND LINKS
In its sole discretion, in addition to any other rights or remedies available
to Inkango.com and without any liability whatsoever, Inkango.com at any
time and without notice may terminate or restrict your access to any component
of the website.
The Inkango.com website contains links to other web sites which are provided
solely as a convenience to you and the inclusion of any link does not imply
endorsement, investigation or verification by Inkango.com or the Third Parties
of the linked web site or information contained therein. Inkango.com and
the Third Parties shall not be responsible for the content of any other
web sites and makes no representation or warranty regarding any other web
sites or the contents or materials on such web sites. If you decide to access
other web sites, you do so at your own risk.
REGISTRATION AND PASSWORD

information (including without limitation and as applicable, any log-in

or not authorized by you. You agree to immediately notify Inkango.com of
any unauthorized use of your registration information or of any other breach

RELATIONSHIPS
The relationship between Inkango.com and you will be that of independent
contractors, and neither of us nor any of our respective officers, agents
or employees will be held or construed to be partners, joint ventures, fiduciaries,
employees or agents of the other as a result of these Terms and Conditions
or use of inkango.com.
GOVERNING LAW
This Agreement and its performance shall be governed by the laws of the
Province of Quebec, Canada. You consent and submit to the exclusive jurisdiction
of the courts located in the City of Laval, in the Province of Quebec, Canada,
in all disputes arising out of or relating to the use of inkango.com and
these Terms and Conditions.
ADDITIONAL TERMS
Additional terms may apply to purchases of products and services offered
on this website. Please refer to your sales contract at the time of purchase.
SEVERABILITY
These Terms and Conditions shall be deemed severable. In the event that
any provision is determined to be unenforceable or invalid, such provision
shall nonetheless be enforced to the fullest extent permitted by applicable
law, and such determination shall not affect the validity and enforceability
of any other remaining provisions.
HEADINGS
The headings used in these Terms and Conditions are included for convenience
only and will not limit or otherwise affect these Terms and Conditions.
ENTIRE AGREEMENT
These Terms and Conditions, together with those incorporated or referred
to herein constitute the entire agreement between us relating to the subject
matter hereof, and it supersedes any prior understandings or agreements
(whether electronic, oral or written) regarding the subject matter, and
may not be amended or modified except in writing, or by Inkango.com making
such amendments or modifications available to it pursuant to the Terms and
